Iron Customer Reach VMAX Terms of Service

Effective date: September 24, 2026

These Terms govern access to Iron Customer Reach VMAX (the "Service"), provided by American Iron LLC ("American Iron," "we," "us," or "our"). By using the Service for an organization, you confirm that you have authority to bind that organization. If your organization has a signed order, subscription agreement, or data-processing agreement with American Iron, that agreement controls where it conflicts with these Terms.

1. The Service and accounts

The Service provides business tools for managing contacts, customer communications, campaigns, templates, analytics, integrations, automation, and optional AI-assisted or voice features. Available features can change over time. You must provide accurate account information, keep credentials confidential, use individual accounts where available, and promptly notify us of suspected unauthorized access. You are responsible for actions taken through your account and for assigning appropriate permissions to users.

2. Customer content and instructions

Your organization retains its rights in the information, contacts, messages, files, prompts, and other material it submits or creates through the Service ("Customer Content"). You grant American Iron a limited, non-exclusive right to host, transmit, display, process, and otherwise use Customer Content only as needed to provide, protect, support, and improve the Service, follow your documented instructions, and comply with law and your written agreement.

You are responsible for Customer Content, its accuracy, and your authority to provide it. You must give people required notices, obtain and record required permissions, maintain suppression and opt-out records, honor requests, and use only contact data you are authorized to use. You must not upload sensitive or regulated data unless the applicable written agreement and the selected Service configuration expressly permit it.

3. Messaging and channel rules

You are responsible for every communication sent using your account, including messages sent by an operator, automation, integration, or AI feature. You must:

You must not use the Service to send unlawful, deceptive, harassing, fraudulent, unsolicited, or abusive communications; impersonate another person; bypass platform protections; upload purchased or unlawfully obtained lists; or interfere with another user's rights. American Iron may suspend a campaign, integration, or account when reasonably necessary to prevent harm, comply with law or a provider's requirement, or protect the Service. For commercial email, customers remain responsible for the applicable sender identification, postal-address, unsubscribe, and opt-out requirements. FTC CAN-SPAM guidance.

4. Integrations and third-party services

The Service may connect to third-party communication, cloud, AI, authentication, or business systems at your direction. Your use of those systems is also governed by their terms and privacy notices. You authorize the Service to exchange Customer Content with the provider you connect to the extent necessary to perform the integration. American Iron is not responsible for a third-party service's independent acts, availability, or terms. You must review provider permissions, retain control of credentials, and disconnect integrations you no longer authorize.

5. AI and automated features

AI-generated text, classifications, summaries, recommendations, or other results are probabilistic and may be inaccurate, incomplete, or inappropriate. You must review them before relying on them or sending them to another person. Unless a signed agreement says otherwise, the Service does not provide legal, medical, financial, or other professional advice. You are responsible for decisions, human review, disclosures, and legally required safeguards for automated communications or decisions.

6. Fees, availability, and changes

Any applicable fees, billing cycle, plan limits, and payment terms are set out in your order, subscription page, or other written agreement. You must pay undisputed charges when due. We may change or discontinue features with reasonable notice where practicable; material changes are subject to your written agreement and applicable law. We do not guarantee uninterrupted availability or message delivery. Third-party networks and channels can reject, delay, filter, or change the availability of communications.

7. Intellectual property and feedback

American Iron and its licensors retain rights in the Service, software, branding, documentation, and related technology. These Terms grant you a limited, non-transferable right to use the Service during your authorized subscription, subject to these Terms. You may not copy, resell, reverse engineer, or use the Service to build a competing service except where applicable law does not allow that restriction. If you provide feedback, you permit American Iron to use it without restriction or payment, provided we do not identify you publicly without permission.

8. Privacy and data protection

Our Privacy Policy explains how information is handled. Where American Iron processes personal information on your behalf, you instruct us to process it to provide the Service and as further described in your written agreement. 9. Term, suspension, and termination

These Terms apply while you use the Service. You may stop using it and terminate according to your applicable order or subscription terms. We may suspend or terminate access for a material breach, nonpayment, legal requirement, security risk, or material threat to recipients, providers, or the Service. When access ends, Customer Content will be handled under the applicable agreement and Privacy Policy. You should export any records you need before termination where the Service makes export available.

10. Disclaimers and limitation of liability

To the maximum extent permitted by law and subject to any signed agreement, the Service is provided on an "as available" basis. American Iron disclaims implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms excludes a warranty or remedy that cannot legally be excluded.

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, revenue, goodwill, or data. Each party's total liability arising from the Service is limited to the fees paid or payable for the Service during the 12 months before the event giving rise to the claim. These limits do not apply where prohibited by law or to liability that cannot be limited; a signed agreement may establish different limits.

11. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules, except where mandatory law provides otherwise. Any action relating to these Terms must be brought in a court of competent jurisdiction in Hillsborough County, Florida, unless applicable law requires another venue. Each party consents to that jurisdiction to the extent permitted by law.

12. Updates and general terms

We may update these Terms by posting a revised version and updating the effective date. Where required, we will provide advance notice of a material change. Continued use after an effective change constitutes acceptance to the extent permitted by law. If a provision is unenforceable, the remaining provisions remain in effect. These Terms, together with the applicable written order and agreements, are the entire agreement about use of the Service and supersede prior discussions on that subject. You may not assign these Terms without our written consent, except as part of a merger or sale of substantially all relevant assets. American Iron may assign them to an affiliate or successor.
